National Level Market Survey of Counterfeit Products (FMCG)

Background:

A law firm approached us on behalf of their client, a famous and leading FMCG company. They informed us that there are some stores in multiple cities selling the counterfeit of their client’s original products. They needed proper solution and reliable information to dig out the supply network chain of counterfeit products.

The client’s main objective was to end the selling of such counterfeit products.

 

Solution:

We told our client that the only way to find out the stores selling the counterfeit products was by conducting the investigation. We suggested our client that if the investigation is conducted, we could collect information like the supply network, markets that are covered for selling such counterfeit products, etc. We could even collect the samples if needed.

We developed the strategy and shared with our client. Our client was impressed with our strategy and told us to proceed with the investigation.

Execution:

We started our investigations at various locations like Mumbai, Surat, Ahmedabad, Kolkata, Hyderabad, Jammu and Kashmir, Thane, Dhule, Nellore, etc.

During the investigation, we noticed that the counterfeit products were almost similar to the original products like graphics, color pattern, design, etc.

We purchased the samples of counterfeit products from all the possible stores along with the invoice and handed over to client.

Thereafter the client gave the collected samples / products in the Laboratory for testing and it was found that the products were actually the duplicate ones.

We clicked the photographs of the samples, name boards, hoardings, etc. as the evidence. We also collected the business card and handed over to client.

During the investigation, we extracted the information as shown below:

 

·         Name of Stores Selling Counterfeit products,

·         Who are the owners of the respective stores?

·         Warehouse of stores.

·         Approximate quantity of the counterfeit products?

·         Who are the suppliers?

·         Details of Suppliers,

·         Areas that are covered in selling the counterfeit products, etc.

 

At last, the market survey was conducted and it was revealed that large number of stores had the counterfeit products and the customers had no idea that the duplicate products are being sold to them.

 

Conclusion:

After the investigation, we gave all those evidences to our client. Our client gave the collected samples to the laboratories for the test. The reports revealed that those were the counterfeit products having low quality ingredient / material and with the help of the evidences collected, our client was able to take the legal action against those stores.
